Charges not a finding of guilt: Reliance Telecom

NEW DELHI: Reliance Telecom said on Saturday the framing of charges against the company and three of its executives "is not a finding of guilt" by the special judge and the firm is confident of mounting a successful defence in the trial proceedings.

The CBI special judge O P Saini framed charges against Reliance Telecom and the three executives in the 2G spectrum case.

The order framing charges has no impact on the licences, operations and business of Reliance Telecom or any other group company, the company said. It said Reliance Telecom and the three executives and or any other person from Reliance ADAG have not received any of the licences issued in January 2008, nor derived any benefits.

"The framing of charges is a preliminary stage in the commencement of the trial process. The framing of charges is not a finding of guilt by the special court," a Reliance Telecom statement said. The trial in the case will begin on November 11.

It said the substantive charges framed on Reliance Telecom and the three executives remain limited only to the alleged abetment to cheating by others, as part of an alleged conspiracy.

"No substantive charge has been framed under Section 409 on Reliance Telecom and the three executives, for alleged criminal breach of trust. The substantive reference to S. 409 is limited to the alleged offences committed by certain public servants, as part of the alleged conspiracy," the statement said,

It said the substantive charges framed on Reliance Telecom and the three executives are on the same lines as per the original chargesheet, and no new charges have been framed.

The statement said Reliance Telecom and the three executives would move the Delhi High Court soon for quashing of the charges.

"With the framing of charges completed, the three Reliance executives will pursue their bail petitions pending before the Hon'ble Supreme Court, which are listed for hearing on 31st October, 2011," the statement added.
